ASSURA | OneDoc General Terms and Conditions of Use
Introduction
These General Terms and Conditions of Use (GTC) govern the use of the OneDoc tool (hereinafter OneDoc) available via the Assura mobile app (hereinafter the App) and, where applicable, other digital media of the Assura Group.These GTC apply in addition to the client portal contract and participation conditions in the client portal, as well as the general terms and conditions of the App. These legal documents apply to OneDoc unless otherwise indicated below.Anyone accessing and/or using OneDoc (a User) acknowledges having read, understood and accepted these GTC.
Producer
The manufacturer and owner of OneDoc is the company OneDoc Ltd, with registered office at Chemin des Mines 15 BIS, 1202 Geneva (OneDoc Ltd).
Nature of OneDoc
OneDoc is a mobile application which allows you to book an appointment with a healthcare professional online. The OneDoc app allows you to manage medical appointments from your mobile phone.
Access conditions
Anyone wishing to use OneDoc via a link provided in the App must be insured with Assura-Basis SA and/or Assura SA, have a customer portal account with Assura, must be validly authenticated via the App and must have accepted these GTC.Use of OneDoc is reserved for persons of majority age who can use it either for themselves or for a third-party beneficiary, such as a child or adult in care.To use OneDoc, the User must have appropriate equipment and a stable internet connection. Assura is not responsible for any technical limitations or the failure of OneDoc in the event of insufficient equipment or connection.
Intended use
The user manual (instruction manual) is provided in the tool itself.The User undertakes to use OneDoc in accordance with these GTC and the instructions for use.The User is in particular not authorised to:
use OneDoc other than for the purpose described in 3 above;
copy, reproduce, modify, extract by crawling or another similar technology (notably data scraping), republish, distribute, make available or divulge to a third party, all or part of OneDoc or its contents;
attempt to proceed with a reverse compilation, reverse engineering or try in any other way to access information which is not freely available or is not supposed to be detectable by users (such as underlying logic or source code).
Insurance conditions
The User may not use information from OneDoc to justify a violation of their insurance conditions.
Disclaimers
To the extent allowed by law, Assura declines (for itself, the producer and any involved third party) all responsibility in the event of use of OneDoc by the User or for any direct or indirect damages resulting from the use of OneDoc.
Modifications to and restriction of functions
Assura reserves the right to suppress, limit or modify the provision of OneDoc at any time without prior notice.
Protection of data
The OneDoc platform is operated by the company OneDoc Ltd, which is a third-party company independent of the Assura Group. Assura has implemented measures to ensure compliance with data protection legislation. In particular, Assura does not transmit any information that could identify the User. The User is redirected securely to the OneDoc platform.In this context, Assura processes the following personal information of the User when using the OneDoc tool:
the date of the click to OneDoc from the Assura application;
where applicable, when the appointment is booked: the name of the family doctor (when listed on the OneDoc platform) or the name of the area of expertise (not the specialist).
the insurance model (product code).
The User expressly consents to the processing by Assura of their personal data after being duly informed and before being redirected to the OneDoc platform. They remain free to book an appointment outside of the service offered by Assura via its application.Assura only uses this data:
to manage its relationship with policyholders, in particular to provide them with a reminder of the applicable insurance conditions, in particular to ensure that they are properly complied with;
it may use the information it collects in this way for the purposes of improving the quality of the functionality provided and the User experience as well as for statistical purposes.
The aforementioned personal data is stored securely for 6 months, which is necessary to pursue the aforementioned purposes.Assura does not have access to any other information that the User provides in the context of its use of the OneDoc platform.By accessing it, the User’s personal data is processed in accordance with the privacy policy and terms and conditions of use of the OneDoc platform available on the OneDoc website.Furthermore, the Assura privacy policy applies.
Intellectual property
Assura and/or its licensors hold all copyrights and all intellectual property rights pertaining to OneDoc. It is notably strictly forbidden to copy any content from the tool.
Reporting problems
The User may inform Assura of any malfunction issues encountered while using OneDoc provided via contact_digital@assura.ch
Final provisions
These GTC are subject to modification by Assura at any time. The User shall be informed of any major modification. Continued use of OneDoc after such changes constitutes acceptance by the User of the new GTC.For any disputes in connection with the use of OneDoc, only Swiss law shall apply. The exclusive place of jurisdiction is Pully.The contractual provisions mentioned under 1 above apply mutatis mutandis.
